Terms of use

1. Acceptance of terms

By accessing or using portal.moblers.com (the "Portal"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Portal. These terms apply to all visitors, users, and clients who access or use the service.

2. Description of service

The Portal is a client delivery platform operated by moblers. It provides project intake, AI-assisted scope estimation, milestone tracking, payment processing, build management, and quality-assurance workflows for custom software development engagements. The Portal supports — but does not replace — the Statement of Work (SOW) agreed between you and moblers.

3. Accounts and access

  • You may be required to sign in via Google or email magic link. You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate information and keep it up to date.
  • moblers reserves the right to suspend or terminate accounts that violate these terms or are inactive for an extended period.

4. Intellectual property

All content, design, code, and trademarks on the Portal are the property of moblers or its licensors, unless otherwise stated in your SOW. Deliverables produced for your project are governed by the IP assignment clauses in your SOW. You may not reproduce, distribute, or create derivative works from Portal content without prior written consent.

5. Application security baseline

Every application moblers delivers under a Statement of Work includes the moblers application security baseline. The baseline covers, at minimum: OS-keychain-backed secret storage (OWASP Mobile Top 10 / M9), HTTPS-only network clients with PII-aware logging in release builds (M3, M5, M6), automated secret scanning and CVE-affected dependency scans on every commit to the production branch (M2), and a one-to-one mapping of every safeguard to its OWASP Mobile Top 10 control. The full baseline — including the list of files, dependencies, and CI checks moblers emits — is published as a downloadable PDF on the Portal home page. Regulated profiles for HIPAA, PCI, or banking workloads (biometric step-up, certificate pinning, jailbreak detection, encrypted local databases) are available under a separate SOW addendum. The baseline reduces but does not eliminate security risk; it does not constitute a warranty against all possible vulnerabilities, nor a substitute for your own application-layer security review before a public launch.

6. AI-generated content

The Portal uses AI services (including OpenAI and Anthropic) to generate scope drafts, budget estimates, and starter code. These outputs are indicative drafts — they may contain errors, omissions, or inaccuracies. A moblers project manager validates all estimates and deliverables before they become binding. You acknowledge that AI-generated content does not constitute professional advice. The application security baseline (Section 5) applies to AI-generated starter code on the same terms as code authored by moblers engineers.

7. Payments

Payments are made via wire transfer (bank transfer) to moblers. Your project manager will provide bank details. Refunds are handled according to our Refund Policy. All amounts shown are indicative until confirmed in a signed SOW. The application security baseline is included at no extra cost and is not separately invoiced or refundable; see the Refund Policy for details. For select ventures, moblers may offer an equity funding plan under which the engagement is paid for in equity rather than cash (standard terms: a 35% stake with an anti-dilution floor of 15%). The funding plan is granted at moblers' sole discretion following review of an application submitted through the Portal, and is governed by a separate equity agreement executed outside the Portal — the Portal records the application and its decision, not the equity contract itself.

8. Acceptable use

  • Do not use the Portal for any unlawful purpose or in violation of any applicable laws.
  • Do not attempt to gain unauthorized access to any part of the Portal, its servers, or any connected systems. Responsible vulnerability reports about the Portal or the apps moblers delivers are welcome at [email protected] and follow a 90-day coordinated disclosure window.
  • Do not upload malicious content, viruses, or any material that could harm the Portal or other users.

9. Limitation of liability

To the maximum extent permitted by law, moblers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Portal or any application moblers delivers. moblers' total liability for any claim related to the Portal or a delivered application shall not exceed the amount you paid to moblers in the twelve (12) months preceding the claim. The Portal and delivered applications are provided with the security baseline described in Section 5 but otherwise "as is" without warranties of any kind, express or implied.

10. Termination

moblers may suspend or terminate your access to the Portal at any time, with or without cause, upon reasonable notice. Upon termination, your right to use the Portal ceases immediately. Provisions that by their nature should survive termination (including IP, the application security baseline obligations in Section 5, limitation of liability, and governing law) will remain in effect.

11. Changes to these terms

moblers reserves the right to modify these terms at any time. Material changes will be communicated via the Portal or email. Continued use of the Portal after changes constitutes acceptance of the revised terms. Changes that reduce the application security baseline below its published level will be communicated at least 30 days before they take effect.

12. Governing law

These terms are governed by the laws of the State of Israel, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the competent courts of Tel Aviv-Jaffa, Israel.
